1. Acceptance of Terms

FictArt (operated by Grand Vision Tech Software Limited) provides its services ("Service") via its website, apps, and related platforms. By accessing or using FictArt, you acknowledge that you’ve read, understood, and agreed to these Terms of Service. If you do not agree, please do not use FictArt.

2. Updates & Notifications

We may update these Terms at our discretion. Changes will be announced through the Service interface, email, or other reasonable methods. Continuing to use FictArt after updates indicates your acceptance. Please review this page regularly to stay informed.

3. Use of the Service

FictArt allows users to create and view AI-generated artworks (“Output”) from user-provided inputs (e.g., text, images) and third-party content. We are constantly improving FictArt; features, styles, algorithms, or platform availability may change or be removed without notice. We are not liable for any alterations or disruptions.

4. User Accounts & Registration

To access certain features, you may need to register and provide accurate contact information. You are responsible for maintaining the confidentiality of your account credentials and for all actions taken under your account. Notify us immediately of any unauthorized access or security issues.

5. Prohibited Uses

By using FictArt, you agree not to:

  • Copy, reverse engineer, or create derivative works based on our platform.
  • Remove copyright or proprietary notices.
  • Use the platform to infringe upon others’ rights, violate laws, or distribute harmful, unlawful, or objectionable content.
  • Harvest user data without consent or send spam, phishing, or unsolicited advertising.
  • Misuse the Service in ways that disrupt our systems or violate third-party rights.

6. Intellectual Property

You retain ownership of content you submit (“User Input”) and the resulting Output generated by FictArt, unless otherwise specified. You grant us a non-exclusive, royalty-free license to host, display, and use the content to operate and improve the Service.

7. Termination

We reserve the right to suspend or terminate your access at our discretion, especially in cases of repeated violations or serious misconduct (for example, using automated programs or scripts to call or abuse our website interfaces).

8. Disclaimer of Warranties

FictArt is provided "as is" without warranties of any kind. We make no guarantees regarding accuracy, reliability, performance, or uptime.

9. Limitation of Liability

To the extent permitted by law, Grand Vision Tech Software Limited will not be liable for indirect, incidental, special, or consequential damages arising from your use of FictArt.

10. Governing Law & Dispute Resolution

These Terms are governed by applicable laws. Any disputes will be resolved under the jurisdiction of the courts in "Hong Kong", unless otherwise stated elsewhere in these Terms.
